Child fell from friends bunk bed gets $850,000 awarded from friends parents!
I cant believe it... what can you say about the stupidity of that. Kids are kids, next time one of your friends kits climbs a tree in your yard and falls out watch out! http://news.ninemsn.com.au/national/...-bunk-bed-fall |

I think we will have to have Risk Management Plans done on our own houses by a 3rd party(some childsafe company that charges $2000), and then have that audited by another 3rd party on a yearly basis to make sure we are complying with the RMP($300 per year)...

It seems common sense has been filtered out of our legal system.
Not plausible that a kid jumped off a bed yelling geronimo??? yeah ok. They should now counter-sue the parents for causing financial grief because they did not teach their son how to obey rules and behave properly indoors. |

Yep and a jugde lets off a teenager for rape, as it was a mistake and a "technical rape".
What's this great nation coming to? GK

Our child fell recently and bruised herself on our slate floor. I am looking to sue the flooring contractor for not using softer slate, perhaps the sponge slate. I'd better not say more it may jeopardise my case.

Yeah...the truth is that the system is crappo, and the people that do the wrong thing are rewarded. I once slipped over on a wet floor at McDonald's...about 20 years ago. Whenever I see a wet floor, I break down emotionally...I think I have a case! :

The thing yes the other parents are at fault for letting the kid sleep on a bed that didn't have a guard or ladder etc.
But what are we coming... I don't know if i was sued for that amount of money I wouldn't know how I would pay,, I don't have anything like that in assets... the parents should sue the bed manufactorer about the dodegy nuts and bolts. But in saying that HOW old was the bed? |

but why should you have to go through your house to make sure everything is safe like OH and S?
I could probable find something wrong with every room. Just looking in this room, well I havn't done Indoor Air Quality testing in here, which is best practice, and can be seen to be a duty of care of the owners of the property( me). er, is that curtain up properly? maybe if someone pulled on it the bar could fall off and stab them in the eye. hm, theres a plastic bag! That could suffocate a little kid..theres a pocket knife on the bench (obviously dangerous), and some metal polish in a tin that could easily poison someone! I could fine heaps more I would think just in this room, which I could be liable for, I would suggest if something came up!! |

I just wouldn't pay. Sneer at the court and tell them to arrest me, as it's the silliest thing you can sue someone for. Lord knows what went through the judges head as he laid down that sentence.

When my kids grow up and what friends to sleep over I'll be getting the parents of the kids to sign a waiver for any and all accidents that may happen to their child. If they don't agree the kids doesn't stay. I'll make up a sleep over form that the kids parents have to sign.
Is this what it has become. Yes. When are you to blame for your own actions. Never. If he knew there was no ladder there then why try to climb down? To me more plausible is kid yelling cowabunga or whatever and leaping from the draws. Sure sounds like a 10 year old to me.
