Default Government stimulus defeated in legal case.

Apparently the stimulus package has all but been proven illegal and we won't be recieving our $900! Does anyone have any information or thoughts on this?I'm not sure on if there's a thread on this so mods delete if unnecessary.
N.B. I'm furious at this if it's true!

As much as Im for recieving $900.. think of it this way, no one's reaching into your pocket, pulling out $900. It wasnt ours to begin with.

Apparently some politician argues it is illegal, and has a strong case for it being illegal. Would be nice to see some people leave that money alone so debt riddled people like me can erase that debt. Also , it might have something to do with how criminals and felons are recieving it too? Not sure on all the facts just heard it on the radio this morning and thought we'd see what you guys think.

This is so screwed up if this guy wanted to Staff up this payment he should've went went to Parliament and Voted Against it but no he has to do it 2 days before ato send all the money, don't these guys have anything else to do nothappy: : : , , i swear if he win's this he'll be the be most hated Man if he successful, and i reallly hope he fails

I'll be kicking myself if this gets passed, I got so excited and everytime I get my hopes up, it all turns out to be one big fart. Like back in school, when they told our class that we were going on a field trip to the cinema, and then at the last minute it was canned. I really wanted to see Harry Potter.

no one has any of this payment yet. the payments that have been handed out already are the ones associated with family tax benefit.

the one in doubt is the one for all workers earning under 80 or 100K i think.

Both those links only state that the handout is being challenged, which is old news, not that it has been defeated, which is what is implied by the OP.

I think it's a Uni lecturer who is doing this, not a Poly.

All I know for certain, is that if this guy 'wins' he will be lucky to get out of the country alive.

He won't be a well liked chap when millions of people have lost $900.

Payments were/are due to start this Thursday, this part of the Economic Stimulus Package has not started yet.

High Court challenge regarding debate as to a gift or payment by previous National Party official and now Law Professor is still in progress. Argument is this is a gift and not possible via the Constitution.

Tax Department wants a quick outcome to meet their Thursday start date.

I'm only going by what was stated this morning. The politician apparently had a strong enough argument and it could likely be passed. Enough to worry me. The announcer also stated it has hefty illegality issues and it would need a reform if it was to fail now and attempt to be passed back through the senate.

Definately was not a politician who bought the case. It was a Uni Professor specialising in Constitutional Law.

Basically, he says the Federal Govt does not have the right to hand out 'gifts'. He was not able to bring a case against it during the December payments as he was not going to get any money out of it and thus did not have a right to bring the case to court. He was/is going to be a recipient of the money this time around though.

Apparently the case is quite well regarded by the High Court, becasue if they thought this fellas argument had no merit at all, he would never have got a hearing in the first place.

Even though I have money earmarked for a new camera lens, I'd expect the government to NEVER break the constitution.

Please, half their Knee Jerk laws in relation to terorrism, police surveillance, and the now bikie clubs are unconstitutional.
If im standing on a street with 2 or more friends, we can be charged with an offence. Now thats bs .
